The process is practically not moving forward, because due to the situation in the world, OFAC is focused on other things. The deadlines for response and consideration of existing requests for licenses on their part are uncertain, and, unfortunately, there is no operational communication.

And in the absence of new information or news, we decided to optimize the general chat support to 2 hours a day, so that we could leave it until the license was obtained and Chatex was released from sanctions.

We collected your frequently asked questions and aim to create one or several posts with answers.

First of all, about our current situation. OFAC, due to the current situation, answers rather reluctantly. Unfortunately, cases, similar to Chatex, are not the top priority right now.

That’s why the process of approval for companies and individuals takes time. If you have already got a license – please, DM Sir.

Questions:
1.Will the current situation affect Russian citizens' funds withdrawal?
No, for Russian citizens the process remains the same. They will be able to get their funds with the help of a common license.
About sanctions: While getting a common license you should remember that transferring funds on any platform, exchange will be illegal, because Chatex’s jurisdiction isn’t in Russia.


2. Why are you not able to create individual license instruction?
It has already appeared in chat, our users shared links. We highly appreciate their support. Also you may find detailed instructions on OFAC’s website.


3. Why can’t you just pay us with your own money?
Unfortunately, we don’t have such an opportunity. Any transaction from the company's addresses will violate OFAC order list, which will lead to risks for all users.


4. What about the duration of this process?
Before the current situation in the world we considered 6-12 months. Now, unfortunately, we are not able to name any concrete date. We’ll try to find any possibility to raise our priority in the OFAC system, but, unfortunately, we don’t obtain it.

There’s no deterioration of information exchange with OFAC. But, it’s not becoming faster either.

First of all, we apologize for the silent week.
At the moment there is no important news. When there is nothing to announce and there are no updates, there is no post either.
It’s not because we’re hiding something. But simply because we are not a newsmaker company and not a meme public.
Work with OFAC continues. At the moment we are giving explanations to all questions of interest to the department regarding operational processes, the work of the company and other nuances.

We are happy that some of our users are in touch with Eric Ferrari and can impartially and first-hand get the news and confirm to the community that the work is really being done.

We really appreciate independent observers from our community and their coverage of the situation and communication with our lawyers.

Regarding the addresses that our users sent to the chat, we want to highlight once again that there have been no transactions since November 9, 2021 in any form.
An exception is the payment of "gas" (gasfee) for transfers to a common storage due to the peculiarities of our system (we talked about it in a previous post ).
We also welcome your desire to verify and confirm our words and posts. Because transactions always have their trail.

Recently, requests for a public speech by the founders of the company increased.
Unfortunately, we cannot proceed with it: lawyers do not recommend posting public appeals from the founders of the company during the trial with OFAC and the Ministry of Finance.
Therefore, we cannot promise such an appeal.

As soon as we have important news about the situation, we will inform you immediately, without waiting for the next Tuesday.

First of all, we’d like to apologize for our absence of content during last week. We haven’t got any news yet. Now we’re keeping up our work with OFAC and conduct all processes required to get a common OFAC license step-by-step.

Moreover, the reference generator continues to work in the bot. All you have to do is to go to the Chatex bot and request a “Balance report”. You will see accurate balance there and this document is applicable for OFAC.

We’d also like to share some of our thoughts about hot topics. Lots of you are interested in news about a potential cryptocurrency ban in the Russian Federation. We are absolutely apolitical, that’s why we just try to clarify some facts.

First of all, the cryptocurrency trading ban. Central bank initiative offers to ban cryptocurrency payments as well as an opportunity to use financial structure (banks, other credit and financial organizations) to provide them.

However this initiative has nothing to do with cryptocurrency holding. This topic wasn’t disclosed. At the moment this initiative is supported by a group from the State Duma.

We’re not going to make any legal forecasts. The fact remains the same – cryptocurrency transactions are regulated by the law “About digital financial assets”. Neither this law, nor the Central bank’s initiative doesn’t restrict cryptocurrency holding.

Another frequently asked question is “What about the time OFAC requests consideration according to the law?” The thing is consideration and application stages are completed. Now we are on the stage of detailed clarification

This stage isn’t regulated, due to absence of OFAC algorithm for effective work with cryptocurrency companies and their assets. It’s a sad irony that even here we’re the first one.

As we’ve mentioned earlier, we think that it’ll take months to clarify all of these issues. Neither we, nor OFAC are able to provide you with a concrete date of our common license approval.

Some time has passed since the sanctions hit, and, effective today, our domain name owner GoDaddy has terminated their partnership with us, complying with OFAC sanctions.
In other words, due to this our website chatex.com is no longer available and we won't be able to relaunch it until the delisting procedure is at an end.
By the way, here is a post we had where we talk about the delisting more, for your understanding!
Factually, GoDaddy did the same thing as BitGo - which is suspending their relationship with us under sanctions - but they did it with a huge delay.
Our group chats and bot will keep functioning either way, and we will keep you updated with our weekly news posts! We are always ready to answer your questions.

We’re here again. We came back to our working process on getting a common OFAC license

We frequently get the same question: are there any legal limits for OFAC requests’ consideration?
The thing is, this consideration stage of our request is completed. Now we are on a stage of detailed work on all important aspects, required to get a license

This stage isn’t legally regulated due to absence of OFAC algorithm for efficient work with cryptocurrency companies. It’s an unfortunate irony – we’re the first one, who faced such legal issues.

Time limits are approximately estimated within months, as we mentioned earlier. Neither we, nor OFAC itself, can provide you with a particular date of getting our common license

However there’s a tiny, but significant news from our side: now any of our users can get a balance statement with the help of a menu button. It’s called a “Balance report”.
There you can find correct balance, and this document can be provided to OFAC in case of getting an individual license

We are waiting for the decision for our enquiry to common OFAC license, as we mentioned earlier. Mr. Erich Ferrari and his team are proceeding our case now. Such cases are the main field of their work.

What is a common license?

It’s an OFAC permit for us, as a company, to adjust (conduct transactions etc) funds which are under sanctions. With this license we’ll be able to bring back assets to our users. Getting a license we want to exclude necessity to get an individual license. It’s much easier to proceed with one inquiry than 10000 users' inquiries.
Important! This license will allow to eliminate other platforms restrictions to work with us. All our addresses are now marked in all AML blockchain screening systems as bringing 100% risk.

I want an individual license
Individual license is an OFAC permission to transfer a user's balance.

Unfortunately, we are not able to provide you with information how to fill in individual license inquiry correctly. We will figure it out if we are rejected to get a common license.

We are getting all of your requests and sending your questions to our lawyers. Also, we send all of your questions about proof of funds, which, according to some users, was asked to provide by OFAC. Any information from us should be validated from OFAC, otherwise it doesn’t make sense.
