On Thursday, January 25, 2024, United States Magistrate Judge Dustin M. Howell issued a recommendation in a contractual dispute over the use of non-fungible tokens, or NFTs, for golf club memberships. The case involved Austin Beach Club, LLC (ABC), which planned to build an innovative golf course in Austin, Texas featuring music venues, a social club, and water activities in addition to golf. ABC sought to partner with Ethereal, LLC, a blockchain consulting firm, to provide memberships to the golf club in the form of NFTs.

An unofficial and experimental Ethereum standard dubbed “ERC-404” — proposed to become a hybrid of fungible and nonfungible tokens (NFTs) — is “working around the clock” to submit an Ethereum Improvement Proposal (EIP), according to one of its inventors. Created by pseudonymous developers known as “ctrl” and “Acme” under a project called Pandora, the standard mixes the tech behind ERC-20 fungible tokens with ERC-721, which is used for one-of-one tokens — such as the NFTs in the Bored Ape Yacht Club (BAYC) collection.

Interoperable payment technologies supported by regulation will be needed to prevent the metaverse from becoming fragmented and dominated by powerful private interests, a study by the Bank for International Settlements (BIS) said. Interest in immersive computer-generated environments, otherwise known as the metaverse, peaked in early 2022, with Facebook changing its name to Meta. “It is not a foregone conclusion that the metaverse will achieve widespread adoption,” the BIS authors said.
